By accessing or using the Proximate app, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, please do not use the app.
Proximate provides a location-based chat experience that allows users to connect with others nearby. You must be at least 13 years old to use the app, and you agree to use it only for lawful purposes.
The app is licensed, not sold, to you. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes on any Apple-branded device you own or control and as permitted by the App Store Terms of Service.
Some features of Proximate may be available through an auto-renewing subscription. Details such as pricing, duration, and renewal terms are displayed clearly on the paywall before purchase. Manage your subscription through the platform you subscribed on.
You agree not to misuse the app in any way, including but not limited to harassing others, sending offensive content, or violating any laws. We reserve the right to suspend or ban users who violate these terms.
You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app. Any support requests, complaints, or claims should be directed to: rashad.nasirli@theproximate.com
You acknowledge that Apple is not responsible for addressing any claims relating to the app, including but not limited to: product liability, legal compliance, consumer protection, or intellectual property infringement. All such claims are our sole responsibility.
The app is provided “as is” and without warranties of any kind, either express or implied. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the app to you. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever.
You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms of Use, and that Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
All content, features, and functionality in the app are owned by Proximate and are protected by copyright and other intellectual property laws. You may not use our content without permission.
We may suspend or terminate your access to the app at any time, without notice, if you violate these Terms of Use or for any other reason at our discretion.
We may update these Terms of Use occasionally. If we do, we will notify users via the app or by updating the date at the top of this page.

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You acknowledge that Google is not responsible for addressing any claims relating to the app or its content, including but not limited to product liability, legal compliance, or intellectual property infringement. All such claims are the sole responsibility of Proximate.
